Suddenly every judge in India has become bold and empowered and has now got power to punish any lawyer who abuses him or shouts at him or tries to bully him during arguments of a case….

It all happened suddenly and unexpectedly.

A week ago, an advocate while arguing a case in Supreme Court, abused and tried to bully one of the judges of a two judge bench.

The Judge did not take this lightly. This was a contempt in face of a court.

Old view was such thst when a lawyer commits contempt of Judge in face of judge, the judge issues him notice of contempt and transfers the case to another judge to deal with the contempt.

This practice was not working effectively. The procedures of issuing notice, proper service of summons, and then filing of reply, and then hearing in other court used to take months and years.

Now law has suddenly taken a leap forward. It has been held that when contempt is made on face of a Judge, the judge can punish him then and there itself…no need to issue notice.

It means this in simple words :

Every Judge in India is now armed with a new power in contempt law. Entire Judiciary has become stronger against 1) ” Lawyers who have nuisance value ” and 2) who “Pride themselves in bullying the judges”.

Indian judiciary has moved forward.

1) In childhood, when basic bricks were being formed in our toddler brain, we saw that every one else in the world is bigger and stronger than us. Then we learned that we have to weep or to do something funny to attract attention, love and food. Our life tracks were then formed. We developed a) Striving for being Superior and Stronger than others b) We developed constant Striving for Recognition by others.

2) In Life, we should first develop roots (earning resources) at place where we are born or live.

3) Secondly, we should develop a stable and loved family. This is a psychological cum biological drive or need.

4) Thirdly, we should have balance in our social circle and life.

As per Alfred Adler, any disturbance in 2,3,4 leads to unrest and psychological problems in life of an Individual.

If we go in excess on point 1, we suffer perils and rejections by world. This point has to be pursued mildly, preferably in a concealed way in order to avoid troubles from the world.

Now try to check these points in real life around you. Try to check your own strivings and struggle in life.

One thing which pains in heart of every law student, lawyer and Judge :- Whenever a politician brazenly breaks order of court or verbally attacks courts, his political popularity increases and he is soon elected with majority votes by people.

An Analysis : This shows that 1) there is deep resentment towards courts, lawyers and judges in heart of people 2) but they do not speak against courts, lawyers and judges because of fear of contempt of court laws.

Two Suggested solutions :

(1) Resentment in heart of people cannot be removed by logic or by force. Rohde Island Judge Frank Caprio has shown a way. Search on You Tube “Rohde Island Judge” and you will see a series of videos which have gone viral on social media. Each video has effect of removing resentment from heart of people. If such videos are made in India, they can remove resentment of people.

(2) Recently a Gujarat court punished three politicians that for one month, they will keep sweeping local civil hospital. And at their expanses complete video of their sweeping will be made. A CD of these video shall be daily deposited in evening with Civil Surgeon of Hospital.

I believe that such measures can remove resentment from heart of people of India.

Small victories and small defeats continue to add up to our mind through out the day. We decide to do something. We are able to do it. This is a small victory of will power. We decide to do something, then we change our mind, or we cancel it, or we are unable to do it due to some reason…this is a small defeat.

If we become observer, we can see these small victories and small defeats through out the day.

In court, three cases are listed. One is won. One is dismissed and one is adjourned. Then there are two defeats and one victory.

We go to meet a person. But he is not there at his seat. This is a small defeat.

The life goes on. If you frequently change your mind, if you frequently cancel your projects, if you keep postponing things, if you are frequently losing cases, if you are frequently prevented with adverse circumstances, then you may form a defeatist’s mindset.

It is within our control to not to change our mind frequently. This one thing can start pulling us out from a Defeatist’s Mindset.

Principle of Unity of soul in business and career – when someone decides to support us unconditionally, unity of soul happens at a higher level. Force is generated when unity of many souls happens.

Once the force is generated, it can be applied to material world to change things.

Gandhiji examplified this principle. More and more souls joined with his soul. And without any election, he became a force.

In business and career same things happen. When your staff, your customers, your clients, your referrals begin to support your soul, you become a force. You begin to prosper.

When we begin to think for “Self Interest”, unity of souls weakens.

The staff, the customers, the clients, the referrals begin to start drifting away from us. Our force weakens.

To understand and remember this principle of Unity of Souls has great advantages in business and career.

If I am jobless, if I am fumbling in darkness, it means that my Unity of Souls is weak. It means that other souls around me have not started supporting my soul unconditionally.

If we are writing to educate people, then our language should be simple. Use of technical words should be avoided so far as possible.

If we are writing for professional colleagues, then the words and the phrases we use should be specific. The statements we make should be authentic and, preferably references for verification should be given.

If we are writing for law students and new junior lawyers, then our words should inspire and motivate them for study of deeper aspects of law.

The point is, “Mind your audience” while writing any article on any topic of law.

Every year, Supreme Court celebrates 26th Nov as “Law Day”. A function is held after court hours by lawyers and judges. Law Minister and Chief Justice are invited. Meritorious advocates are awarded. Lawyers who have published books in previous years are rewarded. Vision statements are made. High tea follows.

What if similar functions are held on same day in every high court and in every district court?

Our religion of Law can become stronger if it happens.

Presently this is only a wish expressed before a falling star in the morning. It is said that such wishes often become fulfilled.
